Terms & Conditions

These Terms & Conditions (“Terms”) govern the use of the website, services, deliverables, and professional engagements offered by Wonderkind Media Pvt Ltd (“Company”, “Wonderkind Media”, “we”, “our”, or “us”).

By engaging with our services, accessing the website, or making payments, the Client agrees to be legally bound by these Terms.

1. SERVICES

Wonderkind Media Pvt Ltd provides professional media and production services including but not limited to:

• • Brand videos
• • Real estate videography
• • Drone shoots
• • Event coverage
• • Product shoots
• • Photography services
• • Social media content
• • Editing and post-production services
• • Motion graphics and digital content creation

Service scope shall be defined through quotation, proposal, invoice, email, or written communication.

2. PROJECT CONFIRMATION

A project shall be deemed confirmed only upon:

• • Written approval from Client
• • Acceptance of quotation/proposal
• • Receipt of advance payment

The Company reserves the right to refuse or discontinue projects at its discretion.

3. PAYMENT TERMS

A. Advance Payment

Unless otherwise agreed:

• • 50% advance payment is mandatory prior to project commencement.

B. Balance Payment

• • Final deliverables shall be released only after complete payment clearance.

C. Delayed Payments

Delayed payments may attract:

• • Project hold
• • Delivery suspension
• • Late fee or interest at commercially reasonable rates

4. ADDITIONAL COSTS

The following may incur additional charges:

• • Extra shoot days
• • Additional revisions
• • Location permissions
• • Talent/model costs
• • Voice-over artists
• • Music licensing
• • Travel, accommodation, logistics
• • Rush delivery requests

5. REVISIONS & APPROVALS

Unless otherwise specified:

• • Standard projects include limited revisions.
• • Major modifications after approval of concept/script/edit may incur additional charges.

Silence or non-response beyond reasonable timelines may be treated as deemed approval for workflow continuation.

6. TIMELINES & DELIVERY

Delivery timelines are estimates and may vary depending on:

• • Client responsiveness
• • Scope changes
• • Weather conditions
• • Technical issues
• • Third-party delays

The Company shall not be liable for delays beyond reasonable operational control.

7. CLIENT RESPONSIBILITIES

Clients shall:

• • Provide accurate information
• • Obtain necessary permissions/licenses
• • Ensure legality of supplied content
• • Provide timely approvals and feedback

The Client indemnifies the Company against claims arising from unauthorized, illegal, defamatory, copyrighted, or misleading materials supplied by the Client.

8. INTELLECTUAL PROPERTY RIGHTS

A. Ownership Before Payment

All raw footage, edits, graphics, concepts, drafts, and creative assets remain property of Wonderkind Media until full payment is received.

B. Raw Footage

Raw footage is not included unless expressly agreed in writing.

C. Portfolio Rights

The Company reserves perpetual rights to use completed work for:

• • Marketing
• • Website showcase
• • Social media promotion
• • Awards and competitions

Confidentiality restrictions must be agreed separately in writing before commencement.

9. MUSIC, STOCK & LICENSES

The Company may use licensed or third-party materials where applicable.

Clients are responsible for obtaining commercial permissions where required unless specifically included in project scope.

10. CANCELLATION & REFUNDS

A. Cancellation by Client

• • Advance payments are non-refundable once planning, scheduling, creative development, or resource booking has commenced.

B. Rescheduling

Rescheduling is subject to team and equipment availability.

C. Emergency Situations

The Company reserves the right to reschedule due to:

• • Illness
• • Equipment failure
• • Force majeure events
• • Government restrictions

11. LIMITATION OF LIABILITY

Under no circumstances shall Wonderkind Media Pvt Ltd be liable for:

• • Indirect or consequential damages
• • Loss of profits or business opportunities
• • Social media/platform algorithm changes
• • Third-party service failures
• • Data corruption or digital loss beyond reasonable control

Company liability, if any, shall not exceed the total amount paid by the Client for the specific project.

12. CONFIDENTIALITY

The Company shall maintain reasonable confidentiality regarding proprietary client information unless disclosure is:

• • Required by law
• • Publicly available
• • Approved by Client

Separate NDA agreements may be executed where necessary.

13. WEBSITE USAGE RESTRICTIONS

Users shall not:

• • Copy or reproduce website materials
• • Attempt unauthorized access
• • Use website content commercially without permission
• • Introduce malicious software or harmful code

14. FORCE MAJEURE

The Company shall not be liable for delays or non-performance caused by events beyond reasonable control including:

• • Natural disasters
• • Internet outages
• • Government restrictions
• • Civil disturbances
• • Pandemic situations
• • Equipment breakdowns

15. GOVERNING LAW & JURISDICTION

These Terms shall be governed under the laws of India.

All disputes shall be subject to exclusive jurisdiction of competent courts in Navi Mumbai / Maharashtra.

16. MODIFICATION OF TERMS

Wonderkind Media Pvt Ltd reserves the right to update or revise these Terms at any time.

Continued engagement with the Company constitutes acceptance of revised Terms.
